Inspection basis

What duty holders need to know.

An excavator used only for conventional earthmoving is primarily managed under PUWER. When it is configured and used to lift suspended loads, the relevant lifting parts and safety devices also come within LOLER.

The contractor must identify whether the machine is used for lifting, ensure the approved lifting point and rated-capacity information are available, and plan lifting operations separately from the examination itself.

Does every excavator need a LOLER examination?
Not solely because it is an excavator. LOLER applies when it is used as lifting equipment. Conventional earthmoving use remains subject to PUWER and other duties.
Can we lift from the bucket?
Loads should only be attached to an approved lifting point in accordance with the manufacturer’s instructions and the machine’s lifting capacity information.
Does the quick hitch form part of the check?
Where it is in the load path or affects attachment retention, its condition and correct operation are safety critical and should be considered.
